Supreme Court Decision On ADC Not Worth Celebrating – Maduabuchi

Oba Maduabuchi, a Senior Advocate of Nigeria says the Supreme Court ruling on the African Democratic Congress, ADC, should not be a cause for celebration.
“Nothing has been concluded,” Maduabuchi told Arise Television’s ‘Morning Show’.

He was reacting to the apex court’s April 30 decision, which set aside the order of the Court of Appeal that barred the recognition of David Mark as the National Chairman of the ADC.

Justice Mohammed Lawal Garba, who led the judgment of the Supreme Court, said the Court of Appeal ought not to have made such an order as it was not sought by any of the parties in the matter.

Maduabuchi said, “In my view, the ADC had no business at the Supreme Court. No appealable decision of the Federal High Court.

“The Court of Appeal exceeded its jurisdiction by making an order that no one asked for. In coming to the right decision that there was no proper appeal by the David Mark faction, the Court of Appeal went one step further and ordered the status quo to be maintained.

That wasn’t right. In the case of David Mark, INEC acted on the order of the Court of Appeal and was on solid ground. “The order of the Appellate Court was to keep status quo ante bellum, not status quo.”
