Due to purported inconsistencies in paperwork submitted for the next election, the Action Peoples Party, or APP, has filed a lawsuit against Bola Oyebamiji, the All Progressives Congress (APC) candidate for governor of Osun State.
Along with Oyebamiji, the Independent National Electoral Commission and the APC were named as defendants in the action, which was filed at the Federal High Court in Osogbo.
Through its agent, Abdulateef R., the APP filed court paperwork requesting that the court consider whether Oyebamiji’s documents complied with the constitutional requirements for voting in the governorship election.
The plaintiff asked the court to decide whether the candidate’s candidacy complies with Section 182(1)(j) of the 1999 Nigerian Constitution as modified in the original summons dated March 16.
The APP asked the court to have Oyebamiji’s name as the APC candidate for the August 15, 2026 election declared invalid.
Additionally, the party requested a permanent injunction prohibiting INEC from acknowledging or interacting with Oyebamiji as an election candidate.
Additionally, the lawsuit requested that the court order INEC to take the APC candidate’s name from the poll’s official list of contenders.
The APC in Osun responded to the development by rejecting the allegations and characterizing the lawsuit as politically motivated and without merit.
The party’s spokesperson, Kola Olabisi, stated, “We were not surprised that such a frivolous suit has been filed against our candidate’s eligibility.”
Olabisi went on to say that the party thought the action was planned to draw attention away from its candidate’s strength in advance of the election.
“We unequivocally declare that our candidate for governor is exceptionally qualified, having fulfilled all legal requirements required to run for office,” he declared.
He insisted that no legal challenge would stop the APC from actively participating in the upcoming governorship election, claiming that the action was a reflection of political opponents’ concern.
